1.1 GoBuzz Marketing, a partnership firm having its registered address at No. 35/1, Ranka Nest, KKS Road, Okalipuram, Bangalore, Karnataka, 560021, India (“GoBuzz”, “we”, “us” or “our”) is managing and operating the website www.gobuzzmarketing.com (“Platform”). The Platform provides communication tools and solutions including Bulk SMS Platform & API, Voice API Integration, Intuitive Email Marketing, and WhatsApp for Business API to businesses (“Users” or “you” or “your”) across India. It is clarified that this Privacy Policy does not govern the collection of personal information of end customers including contact lists uploaded by Users for campaign delivery, outside the Platform.
1.2 This privacy policy (“Privacy Policy”), together with the Terms & Conditions, governs your use of the Platform and describes our policies and procedures on the collection, use, disclosure, processing, transfer, and storage of information provided to us by you. By using, browsing, or accessing the Platform, you agree to be bound by the terms of this Privacy Policy and consent to the collection, storage, possession, dealing, handling, sharing, disclosure or transfer of your information in accordance with the terms herein. We shall not use your information in any manner except as provided under this Privacy Policy. Capitalised terms used herein if not defined shall have the same meaning as ascribed under the Terms & Conditions.
1.3 This document is an electronic record and is governed by the provisions under the Information Technology Act, 2000 and rules made thereunder as may be applicable, the Digital Personal Data Protection Act, 2023, and amended provisions pertaining to electronic records in various statutes. This electronic record is generated by a computer system and does not require any physical or digital signatures.
1.4 This Privacy Policy sets out the type of information collected from Users, the purpose, means and modes of usage of such information and how and to whom we shall disclose or transfer such information. You may at any time withdraw your consent for collection and use of your information including Personal Information (defined hereinafter). However, please note that if you withdraw your consent, we may no longer be able to provide you with the corresponding service. Your decision to withdraw consent will not affect the processing of Personal Information based on your previous consent prior to withdrawal.

2. Type of Information Collected
2.1 You may be asked to provide information anytime you visit, access, use or browse the Platform. We collect information to provide and improve our Services consistent with this Privacy Policy.
2.2 Personal Information includes information that could reasonably identify you, such as:
- Full name, business name, email address, phone number, mailing address
- DLT registration details, sender IDs, message templates
- Billing and payment information
- Account credentials, API keys, usage logs
You agree to provide true, correct, up-to-date and accurate information. You may access, amend, or request deletion by contacting info@gobuzzmarketing.com.
2.3 The Platform is not directed towards minors. We do not knowingly collect Personal Information from Users under 18 years. If we discover such information, we will delete it within a reasonable timeframe. Parents/guardians may contact us for deletion if their child provided information without consent.
2.4 Customer Data Processed on Your Behalf (not governed by this Policy):
- Contact lists (phone numbers, emails, names) uploaded for SMS, voice, email, WhatsApp campaigns
- Message content, delivery receipts, opt-out status
3. Use of Information Collected
We may collect, use or process your Personal Information for:
- 3.1 Delivering, processing, and improving communication Services (API integrations, dashboards, campaign delivery).
- 3.2 Account management, billing, quota tracking, technical support.
- 3.3 Sending service notifications, invoices, compliance alerts, platform updates.
- 3.4 Internal analytics, research, and Platform improvement (aggregate/anonymized data).
- 3.5 Regulatory compliance (TRAI DLT reporting, audits).
- 3.6 Resolving disputes, complaints, or service requests.
- 3.7 Legal requirements or government authority requests.
3.8 Communications (through call, SMS, email or other digital and electronic means) from us and/or our authorized representatives regarding any new services or offerings, even if your contact number is registered under the DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018.
4. Disclosure of Information Collected
4.1 Service Providers: We disclose information to trusted third parties assisting Service delivery:
- Telecom carriers (SMS/voice routing)
- WhatsApp Business API, SMTP providers (email/WhatsApp)
- Payment gateways (Razorpay, tokenized data only)
- Cloud infrastructure (AWS, encrypted)
Such providers are bound by confidentiality obligations and industry security standards.
4.2 Legal Disclosure: When required by law, judicial decree, or to protect our rights, prevent fraud, or ensure safety.
4.3 Business Transfers: During mergers, acquisitions, or asset sales, with equivalent data protection commitments.
4.4 Payment Processors: Third-party gateways collect Financial Information (card/bank details). We are not liable for their actions or security breaches.
4.5 While we implement security measures, the Internet is susceptible to breaches. You must exercise discretion when providing information.
4.6 International Transfers: Data may be processed outside India (e.g., WhatsApp servers, global carriers). By using the Platform, you consent to such transfers under appropriate safeguards per DPDP Act requirements.
5. Security
5.1 We implement security policies and technical measures including firewalls, TLS 1.3 encryption, AES-256 at rest, 2FA, role-based access, DDoS protection, and regular audits to protect Personal Information from unauthorized access, modification, or destruction.
5.2 Information is stored in secured networks accessible only by authorized personnel bound by confidentiality obligations.
5.3 We use international and industry-recognized standards. However, no system guarantees complete security. You agree not to hold us responsible for breaches beyond our reasonable control (hacking, government actions, etc.).
6. Cookies Policy
6.1 We automatically receive your IP address, browser type, OS, referral URLs, and usage patterns to analyze trends and improve Services. This data is not shared with third parties except as required by law or to deliver Services.
6.2 Temporary cookies store session data (no Personal Information). Non-identifiable usage patterns may be shared in aggregate form with partners.
6.3 You may disable cookies via browser settings, though this may impair Platform functionality.
7. Opt-Out Policy
7.1 Third-party providers cannot market to you directly. You may opt-out of non-essential communications via unsubscribe links or by contacting info@gobuzzmarketing.com.
8. Retention of Information
8.1 Personal Information retained only as necessary for Service delivery and legal compliance:
- Account data: Duration of relationship + 7 years (tax records)
- Usage logs: 12 months
- Campaign data: 90 days post-campaign
Data securely deleted thereafter.
9. Modification
9.1 We may amend this Privacy Policy. Updated versions posted on Platform. Material changes notified by email. Continued use constitutes acceptance.
